Terms of Service
These Terms of Service (the “Terms”) are a binding agreement between you and Moremade, a Delaware company (“Moremade”, “we”, “us”). They govern your use of moremade.ai, the Moremade studio, publishing and hosting, domain services, connectors, APIs and any related software or services (together, the “Service”).
Please read Section 18 carefully. It requires most disputes to be resolved by binding individual arbitration and waives class actions and jury trials, unless you opt out within 30 days as described there.
By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for an organisation, you confirm you are authorised to bind it, and “you” includes that organisation. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You may not use the Service if you are barred from doing so under applicable law, including sanctions laws.
You are responsible for your account, for keeping your credentials and any connected sign-in provider secure, and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorised access. We may refuse, reclaim or change usernames, subdomains or project names at our discretion, for example to prevent impersonation or trademark confusion.
2. The Service
Moremade lets you describe websites and apps in natural language, have AI generate and edit source code, preview it, and publish, export or push it elsewhere. Features, models, limits and integrations change over time. We may add, change or remove features, and we may offer beta or preview features that are provided “as is”, may be unreliable and may be withdrawn at any time.
We may set and enforce usage limits (including Build Units, rate limits, file and project sizes, and fair-use limits on hosting and bandwidth) to protect the Service and other users.
3. AI-generated output
The Service uses machine-learning models, including models run by third-party providers. Output — code, text, designs, images and suggestions — is generated automatically and:
- may be inaccurate, incomplete, insecure, buggy, or unsuitable for your purpose;
- may be similar or identical to output generated for other users, and is not guaranteed to be unique;
- is not reviewed by us and is not legal, medical, financial, security or other professional advice.
You are solely responsible for reviewing, testing and securing any output before relying on it or publishing it, including checking that it complies with laws that apply to you (for example privacy, accessibility, consumer-protection, advertising and payment rules) and that it does not infringe anyone’s rights. Automated checks we run (such as build gates, previews and readiness scans) help catch problems but do not guarantee that output is error-free, secure or lawful.
4. Your content and ownership
“Your Content” means the prompts, files, images, data and other materials you submit, and the output generated for your projects. As between you and us, you own Your Content, and we assign to you any rights we may have in the output generated for you, subject to your compliance with these Terms and to third-party rights (for example open-source licences of libraries included in generated code, which remain under their own terms).
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, display and adapt Your Content only as needed to provide, maintain, secure and support the Service — including sending prompts and project context to our AI and infrastructure providers, running builds and previews, and serving sites you publish. This licence ends when Your Content is deleted from the Service, except for copies in routine backups and logs retained as described in the Privacy Policy, or where we must retain it by law.
You confirm that you have all rights, licences and consents needed to submit Your Content and to let us process it as described, and that it does not violate these Terms or any law. Do not submit passwords, API keys or other secrets in chat or project files; use the dedicated connector fields, which store secrets sealed on our servers.
5. Sites and apps you publish
When you publish a site or app, or connect a custom domain, you are the operator of that site or app and are solely responsible for it and for your relationship with its visitors, users and customers. This includes providing your own privacy notice, terms, cookie consent, refund and support policies where required, and handling data you collect through it. For personal data of your visitors that is processed through the Service, you are the controller and Moremade acts as your processor or service provider.
Moremade is not a party to any transaction between you and your customers. Payments your site takes run on your own payment account (for example your Stripe account), under that provider’s terms, and you are responsible for pricing, fulfilment, taxes, refunds, chargebacks and disputes.
We may mark previews and unpublished pages as not for indexing, and we may disable, unpublish or remove any site, app, subdomain or content that we reasonably believe violates these Terms, infringes rights, or creates risk for us, our providers or others, with or without notice.
6. Connected services
The Service can connect to third-party services such as Stripe, Supabase, GitHub, AI model providers, email providers, app stores and build services. Your use of those services is governed by their own terms and privacy policies, and you are responsible for your accounts with them and for all fees, usage and charges incurred on your keys or accounts, including usage triggered by your published sites and apps. We do not control and are not responsible for third-party services, their availability or changes to their APIs. You authorise us to access and act on connected accounts as needed to perform the actions you request.
7. Domains
Domains bought through Moremade are registered with our registrar partners, and you are the registrant. Registration is subject to the registrar’s terms and to ICANN and registry policies, including accurate registrant contact details and dispute policies such as the UDRP. Domain fees are generally non-refundable once a registration or renewal has been submitted to the registry. You are responsible for keeping payment active and renewals on time; we are not liable for a domain lost because a renewal was not paid, a payment failed, or the registry or registrar rejected a request. Moremade subdomains (yourname.moremade.ai) remain ours and are provided to you for use with the Service only.
8. Acceptable use
You must not, and must not help or allow anyone else to, use the Service to:
- break any law or regulation, or infringe or misappropriate anyone’s intellectual property, privacy or other rights;
- create phishing pages, credential or payment-collection pages under false pretences, or sites that impersonate a person, brand or organisation;
- distribute malware, exploits, spyware, or content designed to harm devices, systems or data;
- create or share child sexual abuse material, sexual content involving minors, or non-consensual intimate imagery;
- promote violence, terrorism, harassment or hateful conduct, or threaten or target individuals;
- run scams, pyramid schemes, fake reviews, illegal gambling, or sell illegal or regulated goods without the required licences;
- send spam or unsolicited messages, or publish deceptive or misleading content;
- attack, probe, scan, overload or disrupt the Service or any other system, or bypass security, sandboxing, rate limits, Build Unit accounting or other restrictions;
- reverse engineer, decompile or extract the Service’s source code, prompts or models, except where the law allows despite this restriction;
- scrape or bulk-extract the Service, or use it or its output to build or train a competing product or model;
- mine cryptocurrency, run unrelated compute workloads, or use hosting mainly as file storage or a content-delivery network;
- resell, sublicense or provide the Service to third parties as a service, other than sites and apps you build for your own clients;
- create multiple accounts to obtain extra free Build Units, trials, credits or referral rewards;
- use the Service in high-risk settings where failure could lead to death, injury or serious damage (for example medical devices, life support or critical infrastructure).
We may investigate suspected violations, remove content, suspend projects or accounts, and cooperate with law enforcement and rights holders.
9. Plans, Build Units and billing
Automatic renewal. Paid plans are subscriptions that renew automatically at the end of each monthly or annual term, at the price then in effect, and charge your payment method on file until you cancel. You can cancel at any time in your billing settings; cancellation takes effect at the end of the current term, and you keep paid access until then.
Build Units. Use of the Service is measured in Build Units. Plan units reset every 30 days and do not roll over. Extra units you purchase remain until used, while your account is in good standing. Build Units are a licence to use the Service, not money or property: they have no cash value, cannot be transferred, sold or exchanged, and are forfeited when your account is closed. How many units an action uses may vary and may change.
Payments. Payments are processed by Stripe. You authorise us and Stripe to charge all fees, plus applicable taxes, to your payment method. Prices exclude taxes unless stated; you are responsible for taxes other than those on our income. If a payment fails we may retry it, downgrade or suspend your account, or unpublish paid-plan features such as custom domains.
Price changes. We may change prices. For existing subscriptions, a new price applies from your next renewal after we give you at least 14 days’ notice; you can cancel before it applies.
Refunds. Except where required by law or expressly stated by us, all fees are non-refundable, including for partial terms, unused Build Units, and units consumed by generations you were not satisfied with. If you are a consumer in the EU, UK or another place that gives you a right to withdraw from online purchases, you ask us to start providing the Service immediately and acknowledge that you lose the withdrawal right once performance has fully begun or units have been used, to the extent the law allows.
Chargebacks. Please contact us before disputing a charge. We may suspend accounts with an open or unfounded chargeback.
10. Free plan and promotions
We may offer free plans, trials, gifts (such as gifted domains) and promotional credits. We may change or end them at any time, and they may carry extra limits. Promotions cannot be combined or exchanged for cash unless stated.
11. Affiliate program
If you join our affiliate program, the program terms shown on the affiliates page also apply. We may withhold or reverse commissions earned through self-referrals, fraud, misleading promotion, trademark bidding or spam, and may change or end the program with notice.
12. Our intellectual property and feedback
The Service, including its software, models configuration, prompts, templates, design, text and trademarks, is owned by Moremade and its licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service under these Terms. Nothing else is licensed to you. You may not use the Moremade name or logo in a way that suggests endorsement without our written permission.
If you send us feedback or suggestions, we may use them without restriction or compensation.
13. Copyright and trademark complaints
We respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act and similar laws. Send notices to [email protected] with: your signature; identification of the work; the exact URL of the material; your contact details; a statement of good-faith belief that the use is not authorised; and a statement, under penalty of perjury, that the notice is accurate and you are authorised to act. We may remove or disable material, notify the user, accept counter-notices as the law provides, and terminate repeat infringers.
14. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, in whole or in part, immediately and without liability, if you breach these Terms, create risk or legal exposure for us or others, fail to pay, or if we are required to by law or a provider; and we may end the Service or any free plan with reasonable notice. Where practical and lawful, we will give you notice and a chance to export Your Content.
After termination your right to use the Service ends, published sites may go offline, and we may delete Your Content after a reasonable period, as described in the Privacy Policy. Sections that by their nature should survive (including Sections 3, 4, 5, 9 as to amounts owed, 12 and 15–20) survive termination.
15. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, MOREMADE AND ITS AFFILIATES, SUPPLIERS AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT OUTPUT WILL BE ACCURATE OR LAWFUL, THAT PUBLISHED SITES WILL BE AVAILABLE OR RANK IN SEARCH ENGINES, OR THAT DATA WILL NOT BE LOST. YOU ARE RESPONSIBLE FOR KEEPING YOUR OWN BACKUPS, FOR EXAMPLE BY EXPORTING OR PUSHING YOUR CODE.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MOREMADE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA OR DOMAIN NAMES, OR COST OF SUBSTITUTE SERVICES, HOWEVER CAUSED AND EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) US$100.
These limits apply to every theory of liability and even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence. Some places do not allow certain exclusions, so some of them may not apply to you.
17. Indemnity
You will defend, indemnify and hold harmless Moremade and its affiliates, officers, employees and agents from any claims, losses, liabilities, damages, fines, costs and expenses (including reasonable legal fees) arising from Your Content, sites and apps you publish, your dealings with your users and customers, your use of connected services, or your breach of these Terms or of any law or third-party right. We may take control of the defence of any claim at our cost, and you will cooperate.
18. Dispute resolution, arbitration and class-action waiver
Informal resolution first. Before starting any proceeding, you and we agree to try to resolve the dispute informally for at least 60 days after written notice (to [email protected] for us, or to your account email for you) describing the claim and the relief sought.
Binding arbitration. Any dispute, claim or controversy arising from or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (if you are an individual using the Service for personal purposes) or Commercial Arbitration Rules (otherwise), before a single arbitrator. The Federal Arbitration Act governs this Section. The arbitration may be held by video or on the papers, or in the county where you live or in Delaware. The arbitrator decides all issues, including scope and enforceability of this Section, except that a court decides the class-action waiver and mass-arbitration provisions below.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek an injunction in court to stop infringement or misuse of intellectual property or unauthorised access to the Service.
No class actions or jury trials. YOU AND MOREMADE MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND BOTH WAIVE THE RIGHT TO A JURY TRIAL. If this waiver is found unenforceable for a claim, that claim will proceed in court, not arbitration, after the individual claims are arbitrated.
Mass arbitration. If 25 or more similar demands are filed by or with the help of the same law firm or organisation, they will be administered in batches of up to 25, with one arbitrator per batch, and the remaining demands held until each batch is resolved; the parties will cooperate in good faith on fees.
Time limit. To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
Opt-out. You may opt out of arbitration by emailing [email protected] from your account email within 30 days after first accepting these Terms, stating your name and that you opt out of arbitration.
Consumers outside the United States. If you are a consumer living in the EU, the UK or another country whose law does not allow this Section, it does not apply to you, you keep the protection of the mandatory laws of your country, and you may bring claims in the courts where you live.
19. Governing law and venue
These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply. Subject to Section 18, the state and federal courts located in Delaware have exclusive jurisdiction, and you and we consent to their personal jurisdiction.
20. General
- Changes. We may update these Terms. For material changes we will give notice (for example by email or in the app) at least 14 days before they take effect, unless the change is required by law or addresses a new feature or abuse. Continuing to use the Service after that means you accept the new Terms.
- Export and sanctions. You will comply with U.S. and other applicable export-control and sanctions laws, and you confirm you are not located in, or a resident of, an embargoed country or listed on a restricted-party list.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of third-party providers, networks or AI models.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganisation or sale of assets.
- Entire agreement. These Terms, the Privacy Policy and any terms shown at purchase are the entire agreement about the Service and replace prior agreements. A separate signed agreement with us controls where it conflicts.
- Severability and waiver. If a provision is unenforceable, it is limited to the minimum extent needed and the rest stays in effect. Not enforcing a provision is not a waiver.
- Notices. You agree to receive notices electronically, by email or in the Service. Notices to us go to [email protected].
- Language. These Terms are written in English. Translations are provided for convenience; if they conflict, the English version controls to the extent permitted by law.
- No third-party beneficiaries, and no agency, partnership or joint venture is created by these Terms.
